(3) Purposes of processing

The Kuehne + Nagel entrepreneur app "xLOG" is a mobile application that aims to digitally map the transport chain in the partial and full load sector. For this purpose, the user (driver) has various functionalities available to support his activities during the journey and during the loading and unloading process (e.g. uploading documents accompanying the transport such as delivery receipts / delivery notes, entering exchanged euro pallets and lattice boxes, geo-data of the vehicle can be documented with the app downtimes.

(4) Legal basis for processing

Unless indicated otherwise, the legal basis for the processing of personal data is Article 6 (1) (b) GDPR or - if explicitly provided – the consent Article 6 (1) (a) GDPR.

(6) Transmission of the data to third parties

Your personal data will only be passed on to third parties if this is necessary to provide our services or to preserve evidence of a criminal offense. Furthermore, data can be passed on with your consent.

(7) Order processing

For the cooperation with cooperation partners, which is necessary for the provision of the app and the use of the functions, we have concluded corresponding order processing agreements. Usage data arising when using the app is stored on servers in Amsterdam, Frankfurt and London.

(8) Duration of data storage

Your personal data will be deleted if the data is no longer required to fulfill the purpose for which it was stored, provided that there are no statutory retention requirements to the contrary, or if their storage is inadmissible for other legal reasons.

The tours are saved for 2 weeks in xLOG itself. During this time, all status reports, documents and geographic positions can be called up in xLOG. The GPS data remain in xLOG and are not sent to any TMS. The documents are stored in the data warehouse for 10 years. Status reports are available as long as the shipment itself.

You have the following rights:

According to Art. 15 GDPR, you can request information about your personal data processed by the person responsible (e.g. about the processing purposes, the categories of personal data, the categories of recipients, the planned storage period).

According to Art. 16 GDPR, you can immediately correct incorrect or complete personal data stored by the person responsible.

According to Art. 17 GDPR, you can, under certain conditions, request the deletion of your personal data stored by the person responsible.

According to Art. 18 GDPR, you can request the restriction of the processing of your personal data under certain conditions.

In accordance with Art. 20 GDPR, you can receive your personal data that you have provided to the person responsible in a structured, common and machine-readable format or request that it be transmitted to another person responsible.

According to Art. 7 Para. 3 GDPR, you can revoke the consent you have given to the person responsible at any time. As a result, the person responsible is no longer allowed to continue the data processing, which was based solely on this consent, in the future.

According to Art. 77 GDPR, you can complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or our company headquarters.

(10) Mandatory information

Data marked as mandatory information is either required by law or contract or required for the conclusion of the contract. Failure to provide the mandatory information means that the purposes of the processing cannot be fulfilled.

(11) Automated decision making

There is no automated decision-making in accordance with Art. 22 Paragraph 1.4 GDPR.

(13) App-specific information on data protection

(a) Access of the app to device functions

- The camera / photo function of the device is accessed to record damage to the vehicle and to record documents accompanying the transport, such as delivery notes and delivery receipts.

- Access to the phone / SMS function of the device takes place within the framework of the Surikat SE contact. You will need permission granted in order to contact consignees he is delivering the goods to or his warehouse through the application.

- The GPS function of the device is accessed to determine the location as part of the transmission of your location to Surikat SE. We use ACCESS_COARSE_LOCATION, ACCESS_FINE_LOCATION and ACCESS_BACKGROUND_LOCATION permissions xLOG may collect, use, and share User location Data in order to provide location-based services. xLOG will use user’s location in the backround to optimize deliveries and collections with track and trace for customers as well as enable efficient planning and update of work based on location.

- The device's memory is only accessed as part of the temporary storage of the recorded data. As well as in the event that documents have been photographed in advance.

- Microphone permission allows accessing and recording microphone audio from the User's device. This will allow user to enter the remarks related to the delivery without having to type them in manually.

(b) Data collection

You can use our app by logging in with individual company and user names. without registering or without providing information about yourself. In addition to the location and device data required to use the functionality of the app, we only save access data, such as the name of your Internet service provider. The access data is data that is evaluated to improve the app in the form of usage profiles and does not allow any conclusions to be drawn about your person.

(c) Location determination (only via GPS)

In connection with the use of some functions, we collect your current location via GPS in order to be able to give you quick information about your immediate surroundings and to relieve our dispatchers. You can deactivate the transmission of the GPS position in all common mobile devices (usually in the settings menu). Please understand that in this case not all functions of our app can be available.

(d) Location determination (via GPS, GSM or WLAN hotspots)

In connection with the use of some functions, we collect your current location in order to be able to give you information about your immediate surroundings quickly and to relieve our dispatchers. You can deactivate the transmission of the GPS position or the registration at WLAN hotspots in all common mobile devices (usually in the settings menu). Please understand that in this case only the possibly imprecise localization via the cellular network (GSM localization) is possible, which means that not all functions of our app are available.

(e) Evaluation of non-personal data

In order to continuously improve the user-friendliness and quality of the services we offer and to be able to adapt them to your needs, Surikat evaluates aggregated (non-personal) user behavior data (how often a feature is used, how much time is spent with it).

(f) Data security in the app

We take technical and organizational security precautions to protect your personal data against accidental or deliberate manipulation, loss, destruction or against access by unauthorized persons. Our data processing and our security measures are continuously improved in line with technological developments.

The entire data transfer - both between the app and our backend and to external interfaces - is encrypted (TLS 1.2).

(g) Changes to our data protection regulations

We reserve the right to change our data protection and security measures if this becomes necessary due to technical developments. In these cases, we will also adapt our data protection provisions accordingly and inform you accordingly and - if necessary - obtain your consent.
