Which Personal Data is collected?

Kuehne+Nagel always collects the first name, last name, email address, country (hereinafter the “Mandatory Personal Data”) and other information as street address, city, state/province, zip/postal code, phone number, organisation, job title, industry, number of employees, purchasing time frame, role in purchase process, questions and comments (hereinafter the “Not Mandatory Personal Data”) that you provide when registering for one or more webinars.

You are free to decide whether you want to provide your Not Mandatory Personal Data to Kuehne+Nagel. However, you are obliged to provide the Mandatory Personal Data to register for webinars. If you do not provide the Mandatory Personal Data you will not be able to register. 

The purpose of collecting Personal Data

Kuehne+Nagel uses your Personal Data for the purposes of administering webinars, e.g. giving access to the webinars, to follow up on your registration for and participation in the webinars, including sending out reminders, and to administer and keep track of your learning history. Further, Kuehne+Nagel may also record a webinar for participants unable to attend or for those that want to see it again. Finally, Kuehne+Nagel is measuring your interest and engagement in webinars and using your personal data for analysing purposes to improve our webinars. 

The legal basis for collecting Personal Data

The processing of your Personal Data is based on an understanding between you and Kuehne+Nagel that you will attend one or more webinars, and that the processing of your Personal Data is necessary for the fulfilment of the purposes mentioned above. The processing of your Personal Data is thereby considered necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract, which is Kuehne+Nagel’s legal basis for processing your Personal Data (Article 6, para. 1, lit. b of the General Data Protection Regulation (Regulation (EU) 2016/679)). 

A processing of your personal data for specific purposes (e.g. use of your e-mail address for marketing purposes) can also take place on the basis of your consent. In general, you can revoke this consent at any time. Purposes within the scope of your consent is Article 6, para. 1, lit. a of the General Data Protection Regulation (Regulation (EU) 2016/679)).

Your Personal Data may only be processed for different purposes if this is necessary to comply with legal or regulatory obligations (e.g. transfer to courts or criminal prosecution authorities), if you have consented to the respective processing, or if the processing is otherwise lawful under applicable law. If processing for a different purpose takes place, we may provide you with additional information.

Transfer of the Personal Data 

For the implementation of the webinars and free events, we use the services of companies whose headquarters are in the USA, so that a transfer of your data to third countries cannot be ruled out.

Our respective contractual partner is usually a German or European company of the aforementioned companies. By consenting, you also agree that data will be transferred to the USA and potentially other countries. In such countries, authorities may have easier access to such data and you may have fewer rights to oppose such access, as compared to the European Union.

Kuehne+Nagel ensures that  the data transfer will be carried out in accordance with the applicable data protection laws. This entails that any party outside of EU/EEA which comes into possession of your Personal Data must ensure an adequate level of protection, for example by entering into the EU standard contractual clauses, or by implementing and complying with binding corporate rules, where applicable. To permit us to hold webinars online, Kuehne+Nagel uses the software solution GoToWebinar and GoToMeeting fromGoTo Technologies Ireland, The Reflector Building, 10 HANOVER QUAY, DUBLIN 2, D02R573 in Ireland is the data controller in charge of the provision of this service and the related data processing. Retention period

Your Personal Data will be stored for processing for 1 year after the date of the webinar you signed up for.

Some of your Personal Data may, however, be stored for defence of legal claims. This Personal Data will be stored until the expiration of the statutory limitation period. Moreover, some of your Personal Data may be stored in an anonymised form that does not allow you to be identified.

How can you access your Personal Data?/Further rights

Under applicable law, you have various rights (under the conditions set out in applicable law).

Withdrawal of consent: If you have declared your consent for any Personal Data processing activities you can withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent.

Right of access: You may have the right to obtain from us confirmation as to whether or not Personal Data concerning you is processed, and, where that is the case, to request access to this Personal Data. The access to information includes – inter alia – the purposes of the processing, the categories of Personal Data concerned, and the recipients or categories of recipients to whom the Personal Data has been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict your right of access. You may have the right to obtain a copy of the Personal Data undergoing processing. For further copies requested by you, we may charge a reasonable fee based on administrative costs.

Right to rectification: You may have the right to obtain from us the rectification of inaccurate Personal Data concerning you. Depending on the purposes of the processing, you may have the right to have incomplete Personal Data completed, including by means of providing a supplementary statement.

Right to erasure ("right to be forgotten"): Under certain circumstances, you may have the right to obtain from us the erasure of Personal Data concerning you and we may be obliged to erase such Personal Data.

Right to restriction of processing: Under certain circumstances, you may have the right to obtain from us restriction of processing your Personal Data. In this case, the respective data will be marked and may only be processed by us for certain purposes.

Right to object: Under certain circumstances, you may have the right to object the processing of your Personal Data by Kuehne+Nagel, on grounds relating to your particular situation, at any time. Kuehne+Nagel may be required to cease processing your personal data.

Right to data portability: Under certain circumstances, you may have the right to receive the Personal Data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that data to another entity without hindrance from us.
